"Driving" is not a right in the sense that you do have to meet requirements and so does your vehicle. Beyond that, usage of the road IS your right. With law, the constitution is the main document to defer to. Without probable cause or consent, an officer has no authority to violate your constitutional rights. It's a fundamental American belief that you are innocent until proven guilty. To me your argument is "prove your innocence even if we don't have cause to think you're guilty"
